My husband bought our house after we married, Can he refinance with out my ok?
Don't negotiate in place of a lawyer! Don't ask him what he will accept or not accept. You are not a lawyer and you may be entitled to more. You may be losing more money through your own negotiation than the cost of the divorce. My husband is an attorney and when we divorced he told me I'd get $1000 in child support and alimony. I get much more than that! If you don't want to spend a lot on a divorce, don't fight about things that don't matter, but you have to fight about the things that do matter. Don't be penny wise and pound foolish. He isn't going to refinance if you divorce him. Why would he pay the cost of a refinance? If he takes the money from the house and refinances, that money will be split and will be rewarded to you in the divorce. He can list the house for sale, but it wont sell over night. Also, a divorce attorney can block the sale of the house because it hasn't been determined yet who will keep it or if its best to sell it. Find a good divorce attorney by asking divorced friends who they used. What you need to do is to think logically about every scenario. Don't panic, just think about what a judge would likely decide is fair and you wont panic so much. We have a house that an arbitrator said was to be sold, but my ex and I decided to negotiate because I may buy it. They don't make decisions that don't work for either of you.
